Michele-lee holds the copyright and intellectual property rights for all of her artworks and designs and use is strictly prohibited without Michele-lee's express written permission. Below you can find usage terms which dictate the allowed use of Michele-lee's artworks.
No Commercial Use without Licensing Contract:
You may not redistribute, reproduce, make derivative works or otherwise use the images under copyright of Michele-lee Phelan outside of the terms of use on this page. Images may not be sold or used in any way, including but not limited to, the selling of products, or in connection with the promotion of any type product or sales. Furthermore, no use of any image may infringe upon the rights of existing or potential licensees of Michele-lee's artworks.
You are not permitted to use Michele-lee Phelan's images to manufacture your own products for sale in any form or through any market such as ebay or elsewhere. It is a serious infringement of Michele's copyright to do this.
You are not permitted to use Michele-lee Phelan's images as part of your online auction templates or as part of your online shop logo. You are not permitted to use Michele-lee's artworks for any business logo, stationary, promotional material or signage.
For those companies who wish to license Michele-lee's artworks, please contact the artist.
Graphic/Tagging Use:
For all graphic-based crafts a select number of Michele-lee's artworks are currently in circulation through CILM, however due to the ending of Michele-lee's contract with CILM, they are no longer available for purchase as images and PSP tubes. Those who have purchased the license to use tubes through CILM are entitled to continue using the tubes as long as the the terms stated on the CILM website are followed accordingly. all questions about usage to CILM or refer to their terms of use displayed on their website.
USE OF MICHELE-LEE'S ARTWORK FOR TAGGING AND SIGNATURE GRAPHICS WITHOUT A CILM LICENSE IS STRICTLY PROHIBITED
Update 11/03/2008: Unfortunately due to an inability to police correct usage, Michele-lee has been advised not to offer tubes directly from her website. For now, only those with a CILM license are permitted to use the tubes they have purchased through CILM. Any other use without a license is in breach of Michele-lee's terms of use.
Website Use:
Michele-lee Phelan's artworks may only be used as on websites with a complimentary theme or related subject. For example, her work can be displayed on new age, pagan, wiccan, spiritual, goddess, fairy, dragon, and art related websites. It may not be used in any way that is unrelated or in contradiction to the spirit and message of Michele-lee's works.
No artwork from Art of Faery http://www.artoffaery is to be displayed on any website.
The artworks cannot be used to endorse a product, person, or organisation.
The artworks cannot be displayed at photobucket.com or similar photo upload websites.
The artworks cannot used for commenting or uploaded to photo galleries on myspace.com or similar networking websites. The only exceptions are -- and for display in journal entries only -- livejournal and enchantedfolk.com.
The artworks cannot be used or displayed on sites promoting intolerance, racism, pornography, harm to children in any form, and gambling.
Michele-lee Phelan's artworks and images are licensed to you by the artist for the limited purpose of displaying them on your personal website. Michele-lee reserves the right to revoke, ammend or alter this license on an individual basis at any time.
The following terms must be followed as part of this usage:
The image must be stored on your own website server. DO NOT HOTLINK to any images displayed on any of Michele-lee's websites. To do so is illegal and you will be reported to your webhost for bandwidth theft.
The images are not to be tampered with or altered in any manner. All copyright and website information displayed on the image is to be left intact and unaltered.
The page displaying the artwork must also display a link to www.thewitchwood.com or www.dreamsofgaia.com or www.artoffaery.com and visibly state 'Artwork by Michele-lee Phelan'.
No more than two (2) artworks are to be displayed.
Non Profit or Charity Use:
Please contact Michele-lee regarding charity and non-profit usage as permissions will vary from case to case. Unfortunately, free usage without permission is not allowed, but a limited license can be negotiated.
Tattoo Use:
Tattoos based on Michele-lee's artwork are allowed for individuals only under the following conditions:
Tattoo artists are not allowed to offer any of the artist's works without a signed licensing agreement.
If you wish to have a tattoo based on one of Michele-lee's artworks it is asked that you first purchase a print of the artwork to help support the artist whose work you cherish so much. This will also give the tattoo artist a high quality image to work with.
Once the tattoo is finished you send the artist a photo so Michele-lee can add it to her 'rogue's gallery'.
Copyright Infringement:
Copyright infringement of Michele-lee's works is treated seriously.
Infringers will first be sent an informal request to cease and desist any alleged infringments. This is done as a courtesy before formal action is taken. Compliance at this point is greatly appreciated and no further action will be entered into if compliance is given.
eBay auction of fraudulant derivative products will be ended immediately through the Ebay Vero program. No warning will be given.
Those who fail to comply with the informal cease and desist request will then face other actions such as being reported to their webhost and finally legal action through the courts. Those found to be guilty of copyright infringement will be liable for all court fees and compensations.
Reporting illegal use of Michele-lee's Artwork:
If you see Michele-lee's art being used without proper credit or copyright copyright acknowledgement, or is not in compliance with the terms stipulated within this document, please contact Michele-lee directly with the details. While all reports are welcomed, it is asked that you do not contact the individual, group, or organisation yourself as the item may be licensed legally or from a legitimate retailer.
Activity to be noted as suspicious include the selling of artworks or products without credit given to the artist, individuals claiming that they painted the artworks in question, or customised graphics without any CILM license number visible, whole images without the artist's copyright logo, and websites displaying more than six artworks.
All reports of previously unidentified cases of illegal commercial infringement will be rewarded with a medium print of choice in gratitude.
Detailed Terms and Conditions:
The usage terms stipulated within this document are guidelines only as to the correct and proper use of Michele-lee Phelan's artworks. The artist reserves the right to change the terms and conditions within this document at any time and without any notice. By using any of the artist's works, you give your agreement to the stated terms both now and in the future.
All images and artworks of Michele-lee Phelan's fall under these terms and copyright ownership no matter where or in what medium they are obtained, including but not limited to other websites, purchase of print or products, other manufacturer's products or catalogues.
Regardless of alteration or modification, the copyright of the artworks remains with Michele-lee Phelan under the derivative works terms of Australian and International Copyright Law. Infringment of Michele-lee's copyright will be dealt with seriously.
